Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the sunroute iOS application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use sunroute. By using the Service, you represent that you meet this requirement. If you are between 13 and 18, you represent that you have parental or guardian consent.

3. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account.
  • Usernames must be 3–20 characters, alphanumeric or underscores, and must not impersonate another person or entity.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Generated Content

4.1 Your Content

You retain ownership of content you create and submit to sunroute (“Your Content”), including routes, ratings, reviews, and photos.

4.2 Licence to sunroute

By submitting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, display, and distribute Your Content in connection with operating and improving the Service. This licence ends when you delete Your Content or your account, except where it has been shared with or incorporated into other users’ activities (for example, ratings on routes created by others).

4.3 Content Standards

You agree that Your Content will not:

  • Be false, misleading, or inaccurate (including inaccurate route information)
  • Promote reckless, dangerous, or illegal driving behaviour
  • Include routes that traverse private property, restricted areas, or roads closed to public access
  • Violate any road rules or encourage others to do so
  • Contain hate speech, harassment, or discriminatory content
  • Infringe any third party’s intellectual property rights
  • Contain spam, advertising, or unsolicited commercial messages
  • Violate any applicable Australian or international laws

4.4 Content Moderation

All user-submitted routes are reviewed before being made publicly visible. We reserve the right to reject, remove, or modify any content that violates these standards or that we reasonably believe poses a safety risk. Users may report content they believe is inaccurate or unsafe.

If your route is rejected, you will receive a notification explaining the reason. You may edit and resubmit the route for further review. Repeated submissions of content that violates these standards may result in account suspension.

5. Driving Safety

IMPORTANT SAFETY NOTICE

sunroute is a route discovery and navigation aid. It is not a substitute for your own judgement as a driver. By using sunroute, you acknowledge and agree to the following:

  • You are solely responsible for your driving. sunroute does not control your vehicle and is not responsible for your driving decisions, speed, or behaviour on the road.
  • Obey all road laws. You must comply with all applicable road laws, speed limits, traffic signals, and regulations at all times, regardless of what the app displays.
  • Do not use your device while driving. Secure your device in a mount before driving. Do not hold, type on, or interact with your device while the vehicle is in motion. Where distracted driving laws apply, you must comply with them.
  • Pull over to use the app. If you need to interact with sunroute beyond glancing at navigation directions, pull over safely first.
  • Routes are user-generated. Route information (including road conditions, difficulty, and directions) is contributed by other users and may be outdated, inaccurate, or unsuitable for your vehicle. Always assess conditions yourself.
  • Check conditions before you drive. Road surfaces, weather, closures, and hazards change. sunroute does not guarantee that any route is safe, open, or legal to drive at any given time.

sunroute expressly disclaims all liability for any accident, injury, death, vehicle damage, traffic infringement, or any other loss arising from your use of the app while driving. You use sunroute entirely at your own risk.

6. Prohibited Conduct

You agree not to:

  • Use the Service to engage in any illegal activity
  • Attempt to gain unauthorised access to sunroute systems or other users’ accounts
  • Scrape, copy, or reproduce content from the Service without permission
  • Impersonate any person or entity
  • Upload malware, viruses, or malicious code
  • Interfere with the proper functioning of the Service
  • Create multiple accounts to circumvent a suspension
  • Use sunroute to organise or promote illegal street racing, speeding events, or other dangerous driving activities

7. Badges and Achievements

sunroute awards badges and achievement tiers based on your activity (for example, routes created, routes driven, and ratings given). Badges are calculated automatically and displayed on your public profile. Special badges such as Founding Member or Route of the Week are awarded at our discretion and may be revoked if you violate these Terms. Badges do not have monetary value and cannot be transferred.

8. Push Notifications

With your permission, sunroute sends push notifications to keep you informed about activity related to your account (for example, when a route you submitted is approved or rejected, or when your route reaches a rating milestone). You can manage notification categories in the app’s settings, or disable notifications entirely via your device’s iOS Settings.

9. Intellectual Property

The sunroute name, logo, app design, and all original content created by us are our intellectual property. You may not use our trademarks, branding, or content without prior written permission.

10. Third-Party Services

sunroute integrates with third-party services including Apple Maps/MapKit, Apple Sign-In, and Google Sign-In. Your use of those services is subject to their respective terms and privacy policies. sunroute is not responsible for the availability, accuracy, or conduct of any third-party service.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF ROUTE INFORMATION.

WE DO NOT WARRANT THAT ROUTES DISPLAYED IN THE APP ARE SAFE, LEGAL, OPEN, OR SUITABLE FOR YOUR VEHICLE. ROAD CONDITIONS CHANGE AND USER-GENERATED CONTENT MAY CONTAIN ERRORS.

TO THE EXTENT PERMITTED BY AUSTRALIAN LAW, WE EXCLUDE ALL CONDITIONS AND WARRANTIES THAT MAY BE IMPLIED BY LAW.

12. Limitation of Liability

To the maximum extent permitted by law, sunroute’s total liability to you for any claim arising from your use of the Service will not exceed AU$100 or the amount you paid us in the preceding 12 months, whichever is greater.

We are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Service, including but not limited to: accidents, injuries, vehicle damage, traffic fines, property damage, loss of data, or reliance on route information.

Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

13. Indemnification

You agree to indemnify and hold harmless sunroute, its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Service, Your Content, your driving conduct, or your violation of these Terms.

14. Account Termination and Deletion

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from within the app by going to Profile → Delete Account. Upon account deletion, all your personal data, routes, and reviews are permanently removed in accordance with our Privacy Policy. Upon termination or deletion, your licence to use the Service ends immediately.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via the app or by email. The “Last updated” date at the top of this page indicates when the Terms were last revised. Continued use of the Service after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
